These Terms and Conditions govern your access to and use of the FunkyStation website and services. By using our website, you agree to comply with and be bound by the following terms.
Our website and services are operated by Tyranna Group Limited, trading as FunkyStation. Throughout the site, the terms “we,” “us,” and “our” refer to FunkyStation. We offer this website—including all information, tools, and services—subject to your acceptance of these Terms and Conditions, along with any related policies and notices.
By visiting our site and/or purchasing from us, you engage in our Service and agree to be bound by these Terms and Conditions (“Terms of Service” or “Terms”), including any additional terms and policies linked or referenced here. These Terms apply to all users of the site, including browsers, vendors, customers, merchants, and content contributors.
Please read these Terms carefully before using our website. If you do not agree with them, you may not access the website or use any of our services. If these Terms are considered an offer, acceptance is strictly limited to these Terms of Service.
Any new features or tools added to the site will also be subject to these Terms. You can review the most current version at any time on this page. We reserve the right to update, change, or replace any part of these Terms by posting updates to our website. It is your responsibility to check for changes periodically. Your continued use of the website after updates are posted constitutes acceptance of the revised Terms.
Scope of Terms:
These Terms and Conditions apply to both schools and parents/caregivers participating in the FunkyStation Cashback Rewards Programme. By engaging in the programme, either as a school or a parent/caregiver, you agree to comply with these terms.
- For Schools: These terms govern the school’s participation in the FunkyStation Cashback Rewards Programme, including order placement, cashback payments, and delivery processes.
- For Parents/Caregivers: These terms govern the purchase of FunkyStation products via participating schools, the payment process, and any returns or exchanges related to your orders.
1. General Information
FunkyStation offers fun and creative learning supplies, accessories and digital learning resources through a rewards programme, available only via orders made through participating schools. By ordering from FunkyStation, you agree to abide by the terms outlined in this document.
School Registration Deadlines
Schools must complete registration at least three (3) months before their chosen launch term (for example, to participate in the Term 3 launch, your school would need to register before or by the start of Term 2). This allows FunkyStation sufficient time to prepare resources (e.g., booklets, classroom charts) and ensure a smooth launch. Registrations received after this deadline may be considered at FunkyStation’s discretion, but participation cannot be guaranteed.
2. Ordering Process and Shipment
All purchases from FunkyStation must be made through schools participating in the FunkyStation Cashback Rewards Programme. Orders cannot be placed directly through the website by individual customers whose school is not a participant.
Product Availability: Products are available only during specific programme releases. Availability may be limited based on the release schedule.
- Order Placement: Once a programme is launched, schools will distribute product catalogue booklets and provide order forms to students. Parents/caregivers may submit orders using cash (if their school accepts cash payments) or through the FunkyStation website using the provided online link.
- Payment Required at Time of Order: Orders will not be processed without full payment. Payment must be made at the time of ordering. FunkyStation does not accept "order now, pay later" transactions.
- Final Sales: Orders cannot be cancelled or refunded once payment has been processed through our online system. Please make your selections carefully before submitting your order.
- No Change of Mind Returns: We do not accept returns or exchanges for change of mind after an order has been submitted.
Note: Our no-refund policy for change of mind purchases complies with our programme’s nature, but this does not affect your rights under the Consumer Guarantees Act 1993 in the event of faulty or misrepresented goods. Please note that some products are supplied as assorted styles or colours, as indicated in our catalogue or online. These variations are not considered misrepresentations, as the exact style or colour may differ from images shown. Additionally, if a specific product becomes unavailable due to stock limitations, supplier issues, or other unforeseen factors, FunkyStation reserves the right to substitute it with a product of equal or greater value and similar purpose or style without prior notice.
Delivery Timeline: Delivery takes place in the following term and may take up to 6 to 8 weeks after the two week reconciliation period from the campaign closure date. The delivery timeframe can vary depending on order volume, the number of participating schools and possible freight or supplier delays.
All orders are delivered directly to the school in one bulk shipment. Unlike a regular online store, FunkyStation processes all participating school orders simultaneously to ensure consistent timing, efficient dispatch and coordinated delivery for each school campaign.
All orders are labelled and sorted by year and class, making it easy for schools to distribute them. A class sorting list is included with each delivery to ensure accuracy and a smooth handout process.
If the school took part in the Class Challenge, prizes for the milestones achieved are packed together with the school’s order delivery.
Please note that delays may occur due to high order volume, courier issues, supplier disruptions, or unforeseen events such as natural disasters.
2a. Product Availability and Variations
Some products listed in our release booklets or online shop are marked as assorted/styles may vary/colours may vary, meaning colours or designs may differ and may not exactly match what is shown. Assorted items will be packed based on availability at the time of order fulfilment.
If a specific advertised product becomes unavailable due to stock limitations, manufacturing delays, or other unforeseen circumstances, FunkyStation reserves the right to substitute it with a product of equal or greater value and similar purpose or style without prior notice.
3. Delivery and Liability for Delays
FunkyStation will make every effort to deliver orders within the estimated timeframe. However:
- All delivery dates provided are estimates and not guaranteed.
- Delays due to unforeseen circumstances (e.g., high order volume, courier issues, supplier disruptions, natural disasters, or acts of war) will not be considered a breach of these Terms.
- While we strive to meet our estimated timeframes, delays can occur beyond our control. FunkyStation is not responsible for any consequences resulting from late deliveries, including missed events, deadlines, or additional costs. We appreciate your understanding and patience.
Important: FunkyStation is not responsible for any delays, lost parcels, or damages resulting from incorrect or incomplete delivery information provided on the registration form. Please ensure all fields are completed accurately before submission.
Parent Responsibility for Account Updates
It is the responsibility of the parent or guardian to ensure that all account details — including the child's name, year level, and classroom — are kept accurate and up to date. This helps avoid delivery errors or interruptions if the child changes class or progresses to a new year level. FunkyStation is not liable for issues arising from outdated or incorrect information provided during registration or at the time of ordering.
4. Payment
Online Orders: Payments are processed securely via our website at www.funkystation.com.au Payment must be made at the time of order submission.
Cash Orders: For schools that accept cash payments, families must submit payment together with the completed order form by the specified due date.
School staff are responsible for checking that each order form matches the payment amount received before accepting it. All cash payments must be securely held by the school until the campaign closes.
Once all payments have been collected, the school must count and confirm the total amount before depositing it into FunkyStation’s nominated bank account. A payment summary should be provided to FunkyStation at the time of deposit for reconciliation.
FunkyStation is not liable for any lost or miscounted cash prior to the funds being received in our account. Schools are advised to follow their own cash-handling procedures to ensure safe and accurate processing.
Failure to Pay: Orders will not be processed without payment. Any unpaid orders will be automatically cancelled.
School Cashback Payment and Adjustments
FunkyStation will pay a 20% cashback upfront to registered schools based on total sales through the Cashback Rewards Programme. If a refund is issued for purchased items (e.g., missing or faulty products), 20% of the refunded amount will be deducted from the school’s next cashback payment. This allows FunkyStation to recover the corresponding cashback already paid.
The school will be notified of any adjustments to the next payment.
Example:
- If a school receives $1,000 in cashback for $5,000 in sales, and $200 worth of products are refunded, a deduction of $40 (20% of $200) will be made from the school’s next cashback payment.
5. Risk of Loss
Risk of loss or damage transfers to the buyer once FunkyStation delivers the order to the courier. FunkyStation is not liable for delays, damage, or loss after the order is in transit.
6. Returns and Exchanges
- Non-returnable Products: Due to the limited-time nature of our sales and school programme, FunkyStation does not accept returns or exchanges once an order is processed. Please review your order carefully before submission.
- Faulty or Incorrect Products: If you receive a defective or incorrect product, contact FunkyStation support within 3 days of delivery.
- If available, a replacement will be provided.
- If unavailable, a refund will be issued.
- You may be asked to provide photos or return the product before the issue is resolved.
7. Limitations on Use
Products purchased from FunkyStation are for personal use only. Reselling or distributing FunkyStation products through commercial channels is strictly prohibited. We reserve the right to cancel orders that violate this policy.
8. School Responsibilities
- Schools should distribute product booklets and order forms to students on the same day they receive them to ensure students have sufficient time to place their orders.
- For schools accepting cash payments, the correct amount must be collected with the order form. Schools are responsible for confirming both order accuracy and payment.
- School staff are not FunkyStation employees. Their role is limited to assisting with distributing materials and collecting payments (if applicable).
- Schools are responsible for distributing the correct order items to students upon delivery.
FunkyStation is not responsible for errors made by schools in handling forms, collecting payments, or distributing products.
9. Force Majeure (Uncontrollable Events)
FunkyStation is not liable for delays or failures to fulfil orders due to causes beyond our control, including but not limited to:
- Natural disasters (e.g., earthquakes, floods, fires)
- Acts of war or terrorism
- Government actions or regulatory changes
- Supplier shortages or supply chain disruptions
- Strikes, transport issues, or courier delays
If such events occur, FunkyStation will inform affected schools of any delays, but is not responsible for related inconveniences or losses.
10. Privacy and Data Collection
FunkyStation values your privacy. We collect only the data necessary to process orders and manage the Cashback Rewards Programme. By using our services, you agree to the collection and use of your information in accordance with our Privacy Policy.
11. Disclaimers and Liability
- All products and services are provided “as is,” without warranties of any kind.
- FunkyStation is not responsible for errors, omissions, or inaccuracies on the website or in marketing materials.
- We are not liable for direct, indirect, incidental, or consequential damages (including lost profits or data) arising from use of our website, products, or services.
- Users should verify any important information before relying on it.
12. Liability Limitations
FunkyStation’s total liability is limited to the value of your purchase. We are not responsible for indirect or consequential damages related to product use, shipping delays, or website access.
13. Intellectual Property
All content on the FunkyStation website (including logos, images, text, and designs) is owned by or licensed to FunkyStation and protected by copyright laws. Unauthorized reproduction, distribution, or use is prohibited.
14. Modification of Terms
We may modify these Terms at any time. Updates will be posted on this page with the date of the last revision. Continued use of the website after changes are posted constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of New Zealand. Any disputes will be resolved under New Zealand law.
